Client in Erie County Supreme Court Rape Case Found Not Guilty

A recently accused client was charged and arrested for several sex crimes including, but not limited to, Rape in the first degree. 

NYS Penal Law 130.35: is the most serious of the three rape charges in NY Penal code. If convicted, as a class B felony, rape in the first degree can result in the maximum sentence of 25 years in prison. It is further classified as a violent felony offense. This means if convicted, someone will face a mandatory minimum sentence of 5 years in prison. If convicted of rape in the first degree, the accused would also be required to serve 10 years of probation as well as register as a sex offender under NY Correction Law section 168.

In this particular case, a wife accused her husband of rape, which could have been related to a custody dispute they had ongoing. The case was held in Erie County Supreme Court. The prosecution continuously made offers, which DuBois Law and the client felt were unreasonable.

DuBois Law fought and maintained the client's innocence throughout the entire case. 

After multiple unreasonable offers from the prosecution, DuBois Law forced the case into a trial. The wife (complaintant) was asked to recount her story of the allegations of rape, and when cross examined by each attorney, we were able to demonstrate that her story did not hold up. 

This lack of proof resulted in the client being found NOT GUILTY. 

The Client was found Not guilty on all charges, including, but not limited to, rape in the first degree. All of his rights were then restored, and he can walk freely.
