Batavia Woman Pleads Not Guilty in Death of Genesee County Sheriff at Batavia Downs
On May 21st, 2024, our client Lyndsey Wilcox entered a Not Guilty plea in response to the March 10th death of Genesee County Sherriff's Sgt. Thomas Sanfratello at Batavia Downs. The case has drawn plenty of attention, with the families of both Sgt. Sanratello and Wilcox in attendance, as well as a slew of officers.
The March 10th incident has resulted in serious felony charges being levied against Wilcox, and Daniel DuBois argued for her release under the supervision of Genesee Justice, citing her prior clean record and family presence, showing she doesn't pose a flight risk.
Wilcox's charges are 2nd-degree felony assault and burglary, as well as 2nd-degree misdemeanor obstruction of governmental administration and resisting arrest. District Attorney Kevin Finnell argued the severity of the top charge in particular, and the potential for prison time if convicted. DuBois, on the other hand, pointed to the disparity between Wilcox's charges and those of her co-defendant, Michael A. Elmore. Elmore has been indicted on several more felonies, including 1st-degree aggravated manslaughter.
Wyoming County Court Judge Donald O'Green, presiding over the case, set deadlines for filing motions and bail amounts. He set defense motions to be due by July 12th, the response by the prosecution by July 26th, and arguments for motions on July 31st. He set bail at $20,000 cash, $50,000 security bond, or $100,000 partial insurance bond. Meanwhile, O'Green issued orders of protection that bars both of the defendants from contacting the protected parties until May 20th, 2025.
