Buffalo Man Found Not Guilty of Criminal Possession of a Firearm
In December of 2022, police in Buffalo NY responded to a 911 call. When they arrived, they investigated a vehicle matching a description in the call.
After a search of the vehicle, they discovered a loaded firearm hidden in the trunk of the vehicle.
The front seat driver side occupant was arrested and charged with Criminal Possession of a Firearm and was facing 15 years in Prison.
After further investigation, the Defendant's DNA was found on the weapon.
We conducted a week long jury trial and convinced the jury that the Prosecution failed to prove their case beyond a reasonable doubt, by failing to prove that the defendant had knowingly possessed that firearm.
We worked hard, picked apart the DA's evidence and were able to get the Not Guilty after trial.
When faced with allegations or charges of any criminal nature, especially gun possession, it's vital you retain a quality attorney with trial experience. The more serious the crime, the more serious the need for a quality defense. As we see here in this case, even substantial evidence can be disputed when properly defended. The outcome could be the difference between spending 15 years in prison, or walking freely.
