Working with individuals here in WNY who've found themselves on the wrong side of the law is something we work hard at. We understand that each case is different and aim to help people here in Buffalo and all over New York state. We understand, and we never judge. Today, we're going to take some time to talk about common penalties you could face if you choose to drown your Bills playoff woes and try to go for a drive.
Penalties for DUI in New York
Let's get one thing out of the way: You should never drink and drive. In New York, if you're found guilty of a DWI for your first offense, you get your license suspended for 90 days. A second offense will see it suspended for 6 months. If you're under 21, it could be up to a year.
There are three classes of penalties for being convicted of driving under the influence of drugs or alcohol here in the State of New York. They are -
Administrative Penalties: These penalties are handed down by the DMV. These include the aforementioned suspension and/or revoking of your license, and other penalties. Those could include installing an ignition interlock device to start your car, DUI school, and others.
Criminal Penalties: Penalties can include fines and in serious circumstances, even jail and/or prison time. When there's a minor in the vehicle or a victim that's been injured or killed, hard prison time is not out of the question.
Civil Penalties: If you damage another's property or cause injury while under the influence, you can be held liable for damages, injuries and deaths that occur. Your insurance premium will also see a large spike.
Don't Drink and Drive
The safest and most effective way to ensure you don't lose your license, hurt someone (or yourself), and/or cause property damage is to not drink and drive. Mistakes happen, however, and after years of working in the criminal defense field, especially DWI defense, we understand, we never judge. If you or someone you know is facing the stressor of DWI arrest, please reach out and call a reputable defense attorney before going much further. The end result of your case can be impacted by the earliest impressions, so it's imperative that you retain a trustworthy defense lawyer who will defend your rights.
DISCLAIMER: PAST RESULTS DO NOT GUARANTEE FUTURE RESULTS, AND THE OUTCOME OF YOUR PARTICULAR CASE OR MATTER CANNOT BE PREDICTED USING A LAWYER'S OR LAW FIRM'S PAST RESULTS. EACH CASE IS UNIQUE AND SHOULD BE EVALUATED THROUGH A PHONE CALL OR MEETING WITH DANIEL DUBOIS, WITHOUT COMPARISON TO OTHER CASES WHICH MAY HAVE HAD DIFFERENT FACTS AND CIRCUMSTANCES.
